Update to EU Standard Contractual Clauses
Under the General Data Protection Regulations (GDPR), companies relying on the EU Standard Contractual Clauses (“Old SCCs“) to transfer personal data to third countries must ensure that they transition from the Old SCCs to the GDPR-revised new Standard Contractual Clauses (“New SCCs“) by 27 December 2022. The New SCCs were adopted in June 2021 and replace the three sets of Old SCCs that were adopted under the previous Data Protection Directive 95/46/EC.
The good news is that if you are on Invicti’s standard Subscription Services Agreement terms, then the New SCCs are already included in your agreement with us. However, if you are on a negotiated agreement with us, then it is likely that where SCCs were included within that agreement, these will need to be updated.As a consequence, we have created two versions of the new SCCs for incorporation into the relevant contracts:

In the event that you fail to take such positive action, then we shall deem your acceptance of the Module 2 version of the New SCCs which shall be effective from 27 December 2022.
